After a Death in Kochi: Death Certificate, Legal Heir and the Bank

Register a death within 21 days, then get a legal heir certificate. When banks can and cannot demand a succession certificate under the RBI rules.

After a death in Kochi, three documents do almost all the work: the death certificate from the local body, a legal heir certificate from the revenue department, and, only sometimes, a succession certificate from a court. A death has to be reported within 21 days. If it happened in a hospital, the hospital starts that process and the family downloads the certificate from K-SMART; at home, the family applies.

How do you get a death certificate in Kochi?

Under the birth and death registration rules, a death must be reported within 21 days. The registrar is the local body where the death took place, so a death inside city limits is registered with Kochi Corporation, while a death at a hospital in a neighbouring municipality is that municipality's record.

  • Death in a hospital: hospital staff enter the details through a registration kiosk, a relative or bystander checks them, and the record goes to the local body registrar. The family then downloads the certificate from the K-SMART portal.
  • Death at home from natural causes: call a doctor and get a death declaration. The family applies on K-SMART with that declaration, an officer from the local body's birth and death wing visits to verify, and the certificate usually follows within a few days.
  • Unnatural or suspicious death: the police are involved and a post-mortem has to be completed before the certificate can be applied for.

Check the spelling of every name before the hospital entry is submitted. As our birth certificate guide explains, a correction is recorded in the margin rather than by changing the original entry, and every bank and office after this will compare against what is printed.

The death certificate proves the death. It does not say who the family is. That is the job of the legal heir certificate, which comes from the revenue department. The Village Officer carries out the enquiry; depending on the purpose, the certificate is issued by the Village Officer or by the Tahsildar, and bank and property claims usually go to the Tahsildar.

Apply through the e-District portal, either yourself or through an Akshaya centre, or on paper at the village office. Expect to provide the death certificate, a ration card showing the deceased, and identity and address proof for every heir; paper applications usually also need an affidavit listing all heirs. The fee is small. The wait is the real cost: guides put it at 15 to 30 days after the Village Officer's enquiry. The same portal handles the income, caste and nativity certificates, so the login will not be wasted.

A blunt word of advice: list every heir, including the sibling abroad who does not care about the house. Leaving someone out to make things quicker is exactly what turns into a dispute later.

Do you need a succession certificate for the bank?

Often not, and the rules got simpler. A succession certificate is a court order from the district court under the Indian Succession Act, 1925, and it can take months. The Reserve Bank's 2025 directions on settling claims of deceased customers, which banks had to implement by 31 March 2026, set out when it can be demanded.

SituationWhat the bank can ask for
Account has a nominee or a survivorship clauseClaim form, death certificate and the nominee's ID and address proof. No succession certificate or probate, whatever the amount
No nominee, total up to Rs 15 lakh (commercial bank) or Rs 5 lakh (co-operative bank), or a higher limit if your bank has set oneSimplified procedure: claim form, death certificate, ID and address proof, indemnity, a legal heir certificate or an acceptable declaration, and no-objection letters from the other heirs where applicable. No third-party surety
No nominee, above your bank's limitA succession certificate or probate may be required

Once all documents are in, a deposit claim must be settled within 15 calendar days; if the delay is the bank's fault, it owes interest of at least the bank rate plus 4 per cent a year. Note the nominee rule carefully: the nominee receives the money as a trustee for all the legal heirs, not as its owner.

A short checklist

  • Download several copies of the death certificate from K-SMART; almost every claim wants one.
  • Apply for the legal heir certificate early, because it is the slow one.
  • Ask each bank whether a nominee was registered before doing anything else.
  • Keep the hospital discharge papers and any cremation or burial receipt together.
